Terms of Sale

These Terms of Sale ("Terms") govern the purchase of any product or service offered by Straps Academy ("we," "us," "our"), including but not limited to Straps Academy, Library - Straps Academy, and Library Lifetime Access (each a "Product"). By purchasing a Product, you ("Customer," "you") agree to be bound by these Terms.

1. Products Covered

These Terms apply to all Products sold through the Straps Academy website, including:

• Straps Academy: recurring monthly membership including coaching, movement analysis videos, personalized programming, and related services
• Library - Straps Academy: recurring monthly access to the movement analysis video library and premade programs
• Library Lifetime Access: one-time payment granting lifetime access to the Library, including future additions
• Any other digital product, program, or service offered under the Straps Academy brand

2. Payment

• All payments are processed securely through Kajabi's third-party payment infrastructure. Straps Academy does not directly store or process your full payment card details.
• Prices are listed in the currency displayed at checkout (USD or CAD, as applicable) and are subject to applicable taxes.
• Access to a Product is granted only after payment has been successfully confirmed by our payment processor.
• For subscription Products, payment is billed automatically on a recurring basis (monthly, unless otherwise stated) until cancelled per Section 5.
• We reserve the right to change pricing at any time. Changes won't affect an active subscription until the next renewal, with advance notice where required by law.

3. Access

• Access is personal to the purchasing Customer and non-transferable. Sharing credentials or content may result in immediate termination without refund.
• Straps Academy reserves the right to suspend or terminate access for violations of these Terms or applicable law.
• Lifetime Access means the lifetime of the Product's availability on the platform, not a guarantee of indefinite business operation.

4. Refunds

• All sales are final unless otherwise stated in writing, or required by applicable consumer protection law.
• No refunds for partial use, dissatisfaction with results, or non-use.
• Library Lifetime Access: this Product includes a 7-day money-back guarantee — you may request a full refund within 7 days (168 hours) of your purchase, no questions asked, by emailing [email protected]. Full details, including the multi-payment plan and the rights of EU/UK consumers, are set out in the Library Lifetime Purchase & Service Agreement.
• Where a written satisfaction guarantee is offered for any other Product or promotion, refund requests under that guarantee must be submitted in writing to [email protected] within the guarantee period stated at the time of purchase.
• Chargebacks without first contacting us may result in immediate suspension pending resolution.

5. Cancellation

• Cancel anytime via Kajabi account settings or by contacting [email protected].
• Takes effect at the end of the current billing period; no partial refunds for remaining days.

6. Assumption of Risk and Physical Activity Disclaimer

• Aerial straps training carries inherent risk of injury.
• Customers voluntarily participate at their own risk and confirm adequate physical condition.
• Customers are encouraged to consult a physician before starting, especially with pre-existing conditions.
• Straps Academy, its coaches, and affiliates are not liable for injury, loss, or damage from participation, to the fullest extent permitted by law.

7. Intellectual Property

• All videos, programs, and materials remain the exclusive property of Straps Academy.
• Customers get a limited, personal, non-transferable license for individual use. Redistribution or resale is prohibited without written consent.

8. Eligibility

• Must be 18+ or age of majority. Minors only under a parent/guardian's supervised account who accepts these Terms.

9. Changes to These Terms

Straps Academy may update these Terms at any time; continued use constitutes acceptance. Material changes communicated where legally required.

10. Governing Law

Governed by the laws of Quebec, Canada, subject to mandatory consumer protection law in the Customer's jurisdiction.

Mathis Machure, a self-employed professional based in Canada, operating under the name Straps Academy ("we," "us," "our"), is committed to protecting your personal information. This Privacy Policy explains what information we collect, how we use it, and the rights you have over it.

Depending on how you interact with Straps Academy (browsing the site, signing up for a free resource, purchasing a membership, or contacting us), we may collect:

• Phone number (if voluntarily provided, e.g., for WhatsApp community access or coaching coordination)
• Billing and payment information (processed securely by our payment provider, Kajabi; we do not directly store full payment card details)
• Content you submit, such as training videos sent for coaching feedback
• Any other information you voluntarily provide through forms, messages, or communications with us

We may also automatically collect limited technical information through our website and third-party tools (such as pages visited, device/browser type, and general location) via cookies and similar technologies, including the Meta Pixel.

2. How We Use Your Information

The information collected is used to:

• Provide access to purchased products and services, including Straps Academy, Library - Straps Academy, and Library Lifetime Access
• Deliver coaching, feedback, and personalized programming
• Send updates, offers, and content related to our programs
• Manage customer support and respond to inquiries
• Process payments and manage billing
• Improve our website, content, and marketing based on aggregate usage patterns
• Run advertising and measure its effectiveness (see Section 3)

3. Sharing Your Information

We do not sell your personal information. Your information may be shared with the following categories of third-party service providers, solely for the purposes described above:

• Kajabi — our website, course hosting, email, and payment processing platform
• Meta (Facebook/Instagram) — for advertising, retargeting, and ad performance measurement via tools such as the Meta Pixel and Conversions API
• WhatsApp — for community access and direct coaching communication, where you choose to participate
• Other service providers strictly as needed to operate the business (e.g., email delivery, analytics)

These providers are only permitted to use your information as necessary to provide their services to us, and are bound by their own privacy and data protection obligations.

4. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes described in this Policy, including:

• For as long as you maintain an active membership or account with us
• As needed to comply with legal, tax, or accounting obligations
• Until you request deletion in accordance with Section 6, subject to any retention required by law

5. Data Security

We take reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, or misuse. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.

Depending on your jurisdiction, you may have the right to:
